1.Introduction
This Refund & Cancellation Policy explains how cancellations, refund requests, project termination, and payment disputes are handled by My Geeks LLC (“My Geeks,” “we,” “our,” or “us”).
My Geeks LLC provides website design, website development, website redesign, website maintenance, website improvement, and custom website functionality services to individuals, professionals, small businesses, and other organizations.
Our services are generally project-based. Each project may involve planning, design, development, configuration, testing, revisions, and delivery of agreed website-related work. The time, resources, and work required depend on the selected service, the customer's requirements, and the project scope accepted by both parties.
Because digital services may involve work performed before a website or other deliverable is handed over, refund eligibility can depend on the stage of the project, the payments made, the work completed, the terms agreed before purchase, and applicable law.
This Policy should be read together with our Terms & Conditions and the proposal, invoice, statement of work, or other agreement applicable to the customer's project. Where a specific project agreement establishes additional cancellation or refund terms, those terms will apply to the extent they are consistent with applicable law.
Nothing in this Policy is intended to exclude a consumer right, statutory refund entitlement, or other remedy that cannot lawfully be excluded.
2.Scope of This Policy
This Policy applies to payments made directly to My Geeks LLC for services offered through https://mygeeks.us, including, where purchased:
- Website design.
- Website development.
- New website creation.
- Website redesign.
- Website layout and content-structure improvements.
- Custom website functionality.
- Agreed website integrations.
- Website maintenance and technical improvements.
- Other website-related services expressly included in an accepted proposal or project agreement.
This Policy does not automatically govern purchases made directly from independent third-party providers, such as hosting companies, domain registrars, software vendors, plugin developers, stock-asset providers, or other service providers.
If a customer pays a third party directly, that third party's refund and cancellation terms may apply to the relevant payment.
3.General Refund Principles
We aim to handle cancellation and refund requests fairly and consistently with the agreed project scope and applicable law.
When reviewing a refund request, we may consider:
- The service purchased and the agreed deliverables.
- The total price and payment schedule.
- Whether work has started.
- The amount and nature of work already performed.
- Whether project milestones have been completed.
- Whether deliverables have been provided for review or handed over.
- Any third-party costs properly disclosed and authorized.
- The reason for the cancellation or refund request.
- Any relevant terms agreed in writing.
- Any mandatory rights or remedies under applicable law.
A payment does not automatically become fully refundable or entirely non-refundable solely because it is described as a deposit, milestone payment, or project fee. Its treatment depends on the agreed terms, the circumstances, the work performed, and applicable law.
We will not use this Policy to charge customers for work that was not performed where such a charge would be inconsistent with the agreement or applicable law.
4.Cancellation Before Work Begins
A customer who wishes to cancel a project before work has begun should contact us as soon as possible using the contact details at the end of this Policy.
Where no project work has begun and no non-recoverable costs have been incurred, we will review the request under the applicable agreement and law.
If a refund is appropriate, we will determine the amount based on the payment received, the terms disclosed before purchase, any properly authorized costs already incurred, and any applicable legal requirements.
If project preparation has already started—for example, requirements analysis, project planning, research, configuration, or other agreed preliminary work—we may take that work into account when determining the appropriate refund, provided the relevant charge is permitted under the agreement and applicable law.
Customers should not assume that every payment is automatically refundable in full or automatically forfeited upon cancellation.
5.Cancellation After Work Has Started
Customers may request cancellation after design, development, maintenance, or other project work has begun.
Because work may already have been performed, a cancellation after commencement may not qualify for a full refund.
When reviewing such a request, we may consider the value of work completed, the project milestones achieved, the amount paid, and any applicable cancellation terms agreed before work began.
Where a partial refund is appropriate, the calculation should reflect the applicable agreement, the work reasonably performed, authorized costs, and applicable law.
If the customer has paid for a milestone that has not been completed, the treatment of that payment will depend on the milestone terms, the work already performed toward it, and any applicable refund rights.
We will explain the basis for the refund decision where reasonably practicable.
6.Deposits and Initial Payments
Some projects may require an upfront payment or deposit before work begins. The purpose of an initial payment may include reserving project capacity, starting planning activities, beginning design or development work, or satisfying an agreed payment milestone.
The amount, purpose, and treatment of any deposit should be stated in the accepted proposal, invoice, or project agreement before payment.
A deposit is not automatically non-refundable merely because it is called a deposit. Its refundability depends on the disclosed terms, the circumstances of cancellation, any work already performed or costs properly incurred, and applicable law.
Where a deposit is intended to cover a particular milestone or defined work, the applicable agreement should explain that relationship clearly.
Any cancellation charge or deduction must have an appropriate contractual and legal basis. We will not apply an undisclosed penalty simply because a customer requests cancellation.
7.Milestone Payments
A project may use milestone payments when work is divided into agreed stages, such as planning, design, development, testing, or delivery.
The accepted proposal or project agreement should identify the milestones, their associated payments, and any applicable approval or delivery requirements.
If a customer cancels after one or more milestones have been completed, we may consider the completed work and payments associated with those milestones when reviewing the refund request.
Payments relating to incomplete milestones will be reviewed according to the agreed terms, the work already performed, and applicable law.
If a milestone has been paid for but the corresponding work has not been performed, we will assess whether a refund or other adjustment is required under the agreement and applicable law.
8.Refunds for Completed Services
Once the agreed services have been completed and the corresponding deliverables have been provided, a customer may not be entitled to a full refund merely because they have changed their mind or no longer wish to use the deliverables.
However, completion does not remove any refund, repair, correction, or other remedy that may be required by the accepted agreement or applicable law.
If a customer believes that completed work materially fails to meet the agreed project scope, they should contact us with a description of the issue.
We will review the issue against the agreed deliverables and determine whether it represents:
- A defect or omission in the agreed work.
- A misunderstanding about the original project scope.
- A request for additional functionality or a new design direction.
- An issue caused by a third-party service or a later change outside the original scope.
Where appropriate, we may offer a correction, completion of an omitted agreed deliverable, or another reasonable resolution consistent with the agreement and applicable law.
A request for additional features, a new design direction, or work outside the accepted scope may require a separate quotation and is not automatically a basis for a refund of properly completed work.
9.Requests to Correct Work
If a customer identifies an issue with a deliverable, the customer should contact us promptly and provide enough detail for us to investigate.
Where the issue concerns a failure to deliver functionality or work expressly included in the accepted scope, we will review the matter and, where appropriate, take reasonable steps to correct the issue.
Where the issue is instead a request for new functionality, additional pages, a materially different design, or another change outside the original scope, the request may be treated as additional work.
A correction or revision process does not remove any mandatory rights the customer may have under applicable law.
10.Customer Delays and Incomplete Projects
Project progress may depend on the customer providing content, images, access credentials, approvals, feedback, or other necessary materials.
If the customer does not provide required information or approvals within a reasonable period, the project schedule may be delayed or the project may need to be paused.
Where a delay continues, we may contact the customer to clarify whether the project should remain active, be rescheduled, or be closed in accordance with the accepted agreement and applicable law.
Customer delay does not automatically entitle My Geeks LLC to retain every payment regardless of the circumstances. Any amount retained following cancellation or closure must be supported by the agreement, the work performed or costs properly incurred, and applicable law.
If a project is paused for an extended period, the parties should confirm in writing any revised timeline, outstanding responsibilities, and payment obligations before work resumes.
11.Cancellation by My Geeks LLC
In certain circumstances, My Geeks LLC may need to cancel a project or determine that it cannot reasonably continue providing the agreed services.
Possible reasons may include:
- The customer requests unlawful work.
- The customer does not provide essential information or authorized access after reasonable requests.
- A material payment obligation remains unresolved.
- The customer materially breaches the project agreement.
- The requested work proves impossible to perform as agreed because of a significant technical or third-party limitation.
- Circumstances arise that prevent us from continuing the project.
Where reasonably practicable, we will communicate the issue and provide an opportunity to resolve it before cancellation, unless immediate action is reasonably necessary or the agreement or law permits otherwise.
If we cancel a project, we will review the payments received, the work completed, the deliverables provided, any properly authorized costs, and the applicable agreement.
Where a refund is due, we will arrange it in accordance with the applicable agreement and law. We will not charge for undelivered work where doing so would violate the agreement or applicable law.
12.Third-Party Costs and External Services
A website project may involve third-party products or services, including domain registration, hosting, paid themes, plugins, software subscriptions, stock assets, external APIs, or other services supplied by independent providers.
Unless expressly included in the agreed project price, these costs may be charged separately or paid directly by the customer to the relevant provider.
Where My Geeks LLC has incurred a third-party cost on the customer's behalf, the treatment of that cost following cancellation will depend on whether it was disclosed, authorized, recoverable from the third party, and properly chargeable under the agreement and applicable law.
We cannot promise that an independent third-party provider will issue a refund. If a customer paid the provider directly, the customer may need to submit the request to that provider.
Any third-party charge included in a refund calculation must have an appropriate basis and must comply with applicable law.
13.How to Request a Cancellation or Refund
To request a cancellation or refund, contact My Geeks LLC using the details below.
Email: support@mygeeks.us
Phone: (888) 973-3308
Website: https://mygeeks.us
Please include the following information where available:
- Your name and business name.
- The email address associated with your order or project.
- The invoice, order, or project reference.
- The service or package purchased.
- The date and amount of the payment.
- Whether work has started or deliverables have been provided.
- The reason for the cancellation or refund request.
- Any relevant information about the issue you want us to review.
Providing these details can help us locate the relevant transaction and assess your request.
Please do not include full payment card numbers, card security codes, account passwords, or unnecessary sensitive personal information in your request.
We may ask for additional information reasonably necessary to verify the transaction or understand the circumstances.
14.Review and Processing of Refund Requests
We will review cancellation and refund requests in light of the relevant transaction, project records, agreed terms, and applicable law.
We aim to acknowledge requests within a reasonable period and communicate the outcome once we have sufficient information to make a decision.
If a request requires additional information or investigation, the review may take longer. We will make reasonable efforts to explain any material delay.
If a refund is approved, it will generally be processed through the original payment method where supported and appropriate. If that method is unavailable, we may contact the customer to arrange a lawful alternative.
The time required for the funds to appear in the customer's account may depend on the payment provider, bank, card issuer, and payment method.
An approved refund does not necessarily appear immediately after we initiate the transaction. Customers may need to contact their payment provider if a refund has been processed but has not appeared within the provider's normal processing period.
Any refund amount and any applicable deductions will be determined according to the agreed terms, the circumstances, and applicable law.
15.Duplicate Payments and Incorrect Charges
If you believe that you have been charged twice for the same purchase or that a transaction amount is incorrect, contact us promptly.
Please provide the relevant invoice or transaction reference, the dates of the transactions, and the amounts involved. For security, do not send complete payment card details.
We will review our records and, where relevant, the information supplied by the payment provider.
If a duplicate payment or incorrect charge is confirmed, we will take appropriate corrective action, including arranging a refund where required.
A transaction that appears unfamiliar should also be checked with the relevant payment provider or financial institution if there is reason to suspect unauthorized activity.
16.Unauthorized Transactions and Payment Disputes
If you believe that a payment was made without your authorization, please contact us promptly and contact your payment provider or financial institution as appropriate.
We will review relevant records available to us and cooperate with legitimate transaction investigations in accordance with applicable law and the relevant provider's procedures.
Customers should first contact us about ordinary billing questions or project disputes where doing so is appropriate. However, nothing in this Policy prevents customers from exercising their rights to raise a dispute with their payment provider, financial institution, or a competent authority.
A chargeback or payment dispute will be handled according to the payment provider's rules, applicable law, and the evidence available. We will not treat every dispute as proof of misconduct by the customer.
17.Non-Refundable Items and Exceptions
We do not impose a universal no-refund rule for all services or payments.
Some charges may not be refundable in particular circumstances—for example, where a clearly disclosed and lawful fee relates to work already completed or a properly authorized third-party expense that cannot be recovered.
Any such treatment must be consistent with the accepted agreement and applicable law.
Nothing in this Policy prevents a refund or other remedy where required by law, including where a service was not provided as agreed or a mandatory consumer protection applies.
18.Statutory and Consumer Rights
Depending on the customer's location, the nature of the purchase, and the applicable law, customers may have cancellation periods, refund rights, rights relating to defective or misdescribed services, or other statutory protections.
These rights may apply even where a general contractual provision would otherwise suggest a different outcome.
This Policy does not waive, limit, or replace any right that cannot lawfully be waived, limited, or excluded.
If a mandatory legal requirement conflicts with this Policy, the mandatory requirement will apply to the extent of the conflict.
Customers who believe that a statutory right applies to their purchase should contact us with relevant details so that we can review the matter.
19.Changes to This Policy
We may update this Refund & Cancellation Policy to reflect changes to our services, business processes, payment arrangements, or legal obligations.
The latest version will be published on https://mygeeks.us with an updated Effective Date.
Where a change affects an existing transaction or agreement, the change will apply only to the extent permitted by the applicable agreement and law. We will not use a website update to remove a customer's existing mandatory legal rights.
Customers should review the policy applicable to their purchase and retain copies of their accepted proposal, invoice, and project agreement.
